Shall the following provision of Chapter 6 of the Code of Ordinances of the City of Cape Girardeau, Missouri, relating to the dog or cat license fee, be amended to read as follows:

Sec. 6-27. License; fee, requirements; issuance of metal tag by city clerk.

Any person owning, controlling, possessing or having the management or care of any dog or cat shall apply to the city clerk and obtain a city license annually on or before April first of each year. The fee for the license is fifteen dollars ($15.00) for each dog or cat not spayed or neutered and three dollars ($3.00) for each dog or cat that has been spayed or neutered. Any person over the age of sixty-five (65) may purchase a license at on dollar ($1.00) for any spayed or neutered dog or cat and five dollars ($5.00) each for unaltered dogs or cats. A licensed breeding kennel may purchase a license at three dollars ($3.00) for each dog or cat regardless of whether such dog or cat has been spayed or neutered. The applicant for the license for any dog or cat over six (6) months of age shall present a certificate of inoculation of such dog or cat against rabies issued by a licensed veterinarian and showing that such inoculation is medically valid for the period within which the license is to be effective. The owner must also provide a certificate from a licensed veterinarian as proof that the animal has been spayed or neutered. Upon fulfilling these requirements the applicant shall receive from the city clerk a metal tag of suitable design inscribed with the words "Cape Girardeau animal license" with the year of issuance. He shall securely attach the tag to the animal by means of a collar or harness of substantial make and condition. The metal tags shall be numbered consecutively.

Sec. 29-34. Connections to public sewers in district outside boundaries; requirements generally.

  (a) Any person owning a lot or parcel of land lying outside the boundaries of a sewer district in which a sanitary sewer has been constructed, may, upon written application to the city council, be permitted to connect such lot or parcel of land with such sewer upon payment to the city clerk a sum of two hundred fifty dollars ($250.00) for each connection of any one (1) building. Restaurant means any inn, establishment, adult person or entity other than a caterer while performing catering services, engaged in the retail sale of food prepared by the restaurant, or by using the restaurant's facilities, on or off the premises and sold for immediate consumption within or away from the premises. The term "Restaurant", however, shall not include entities that are exempt from federal income tax while engaged in their exempt functions and activities, but shall include hospitals, nursing homes and convalescent centers unless they are engaged in the preparation and delivery of food to their patients or residents; and

Sec. 15-396. Definitions and rules of construction

Terms used in this article shall have the meaning ascribed to them in this section and shall be construed as indicated in this section:

   Food means all articles commonly used for food or drink, including nonalcoholic beverages.

   Gross receipts is based upon the applicable revenue received by the licensee and not on the basic charge made to the customer by the licensee. For example, gross receipts shall be construed to include all sales taxes.

   Hotel and motel means any structure, or building, under one (1) management, which contains a room or rooms furnished for the accommodation or lodging of guests, with or without meals being provided, and kept, used, maintained, advertised or held out to the public as a place where sleeping accommodations are sought for pay or compensation to transient guests or permanent guests.

   Prepared shall include cooked, mixed, heated, assembled, at least in part, or served and shall also include the dispensing of drinks from a fountain.

   Transient guests means any person who occupies a room in a hotel or motel for thirty-one (31) days or less; and

Sec. 15-397. Levy of the tax

There is hereby levied a license tax on hotels and motels in an amount equal to three (3) percent of gross receipts derived from transient guests for sleeping accommodations, and on caterers serving one hundred (100) or more people at any one (1) function and on restaurants in an amount equal to one (1) percent of gross receipts derived from the retail sale of food prepared by the restaurant, or by using the restaurant's facilities, on or off the premises and sold for immediate consumption within or away from the premises. This license tax shall be in addition to all other license taxes which are applicable to hotels, motels and restaurants, but shall not apply to gross receipts derived from sales made to individuals or entities showing proof of their exemption from Missouri or Federal sales taxes.
