CR389-11F - Sandra Renae Hill (Rankin) Perjury
Defendant lied during a deposition in a criminal case against Johnny P___ for delivering marijuana, when she denied that she had supplied marijuana to Johnny P___, when in truth she had provided the marijuana to Johnny P___ for him to deliver to Harold M____, and this was material to whether Johnny P___ was aiding in the sale of the marijuana to Harold M____. RESULT: Pled Guilty; 5 years, SES, numerous conditions of probation, including 200 hours community service.
CR589-1594F - Charles Rowland Beardslee Perjury
An elderly man in a divorce proceeding perjured himself by lying about the disposition of his assets by claiming that he had paid the proceeds from the sale of the family residence to a farm implement company when in truth he had not paid them, and this was material to the issue of the distribution of assets in the property settlement. RESULT: Pled Guilty; 2 Years, SES, numerous conditions of probation including 100 hours community service.
CR391-15F - Theresa Verline Wade Perjury
Defendant being investigated for possession of cocaine found in her apartment during the execution of search warrant, lied in testimony to grand jury by claiming that she did not use cocaine and had never used it, when her urine test results showed positively that she had used cocaine within 6 hours prior to her testimony to the grand jury. RESULT: Pled Guilty; 3 years, SES, 100 hours community service, 30 days in-patient, 60 days shock detention; probation later violated and Defendant sent to prison.
CR591-550F - Daniel Duke Richards Perjury
Defendant was testifying at the criminal jury trial of Brian Williams for assault and DWI and falsely claimed that R____ M____ had been the driver of the pick-up truck on the night in question, when in truth Brian Williams had been the driver. Four witnesses established the lie, which was material to the issue of whether Brian Williams had been operating a motor vehicle while intoxicated. RESULT: Pled Guilty; 2 year prison sentence to serve.
CR591-551F - R____ M_____ Perjury
Defendant was testifying at the criminal jury trial of Brian Williams for assault and DWI and falsely claimed that R____ M_____ had been the driver of the pick-up truck on the night in question, when in truth Brian Williams had been the driver. Four witnesses established the lie, which was material to the issue of whether Brian Williams had been operating a motor vehicle while intoxicated. RESULT: Pled Guilty; Suspended Imposition of Sentence, with numerous conditions of probation. [Note: Defendant’s name is withheld since she received a suspended imposition of sentence and her file is thus not a public record.]
CR591-826F - John Ing Perjury
Defendant was testifying in criminal preliminary hearing of Kenneth Mayfield for felony assault and armed criminal action. Defendant lied by claiming that when he named Kenny Mayfield as the person he had seen shoot M_____ W_____ he was just giving the officers the name they had first suggested to him as the shooter, when in truth he had named Mayfield as the shooter before the officers had mentioned any names of suspects. Material on issue of identification of Mayfield as shooter. RESULT: Pled Guilty; 5 years, SES, 20 days shock, 300 hours community service.
CR592-156F - Steven E. Wiley Perjury
Defendant lied at his own criminal trial for DWI by claiming the location of his car wreck was 2 miles from an intersection instead of 1/2 mile, and this was material as to whether he had been intoxicated at the time of the accident because if the accident occurred where he testified it did it bolstered his claim that he had time to walk home and do his drinking before coming back to the scene and meeting the officers there. RESULT: Pled Guilty to Attempted Perjury; Fined $350.
CR592-157F - Glen Ellis Perjury
Defendant lied at criminal DWI trial of Steven Wiley by claiming the location of Wiley's car wreck was 2 miles from an intersection instead of 1/2 mile, and this was material as to whether Wiley had been intoxicated at the time of the accident because if the accident occurred where he testified it did it bolstered Wiley's claim that he had time to walk home and do his drinking before coming back to the scene and meeting the officers there. CR592-1081F - A____ M____ Perjury
Defendant was charged with lying at a motion to suppress in a criminal DWI case against her son by claiming he was at home with her at the time of the DWI, when in truth he was in the process of being arrested, booked and run on the breathalyzer by the State Trooper. The issue involved the timing of the arrest and the giving of the breathalyzer. RESULT: The case was later dismissed by the prosecution. [NOTE: Defendant’s name is not used since the file is a closed record as a result of charges being dismissed.]
CR595-278F - Bradley Wayne McIntyre Perjury
Defendant lied in small claims court bench trial where Delmar C____ was suing him for money Delmar had loaned him to start a restaurant, by claiming he had never borrowed the money from Delmar and even adding that he had never even had anything to do with a restaurant, when in truth the State could show he had rented the building from his landlord to open a restaurant and had applied to the city for a restaurant license. RESULT: Pled Guilty; Fined $250.
CR597-1615F - Margaret Rose Gilmore Perjury
Defendant charged with lying at a hearing concerning a civil order of protection in front of Judge Peter Statler by testifying falsely that she had not entered the home of her estranged husband other than stepping briefly inside, when a surveillance videotape showed her going into the residence and going through papers on the kitchen table, opening the refrigerator, and going into the garage before leaving the residence. RESULT: Defendant found guilty at jury trial, sentenced to 5 years in prison, SES, plus a $5,000 fine.
CR598-359F - M_____ L_____ Perjury
Defendant on trial for misdemeanor possession of drug paraphernalia, lied as to her number of prior DWI convictions. RESULT: Defendant pled guilty and received a suspended imposition of sentence and was placed on probation for two years with numerous conditions of probation. [Name withheld since record is closed due to suspended imposition of sentence.]
CR599-442F -S____ D____ Perjury
Defendant and her boyfriend were being prosecuted for drugs found in her apartment. At the time of her guilty plea, she said that the drugs belonged to her boyfriend and that she had simply allowed him to keep them at her place. At his preliminary hearing, she said under oath that they were her drugs and that he knew nothing about them. She was charged with perjury for her lies at his preliminary hearing. RESULT: Defendant acquitted due to fact she was not under oath at the time of her guilty plea and prosecution thus did not have two conflicting sworn statements under 575.070 (4).
CR500-363F - Paul David Rains Perjury
Defendant lied at a civil order of protection hearing by saying he had never had any type of sexual contact with a teenage girl. DNA tests subsequently conducted upon the girl’s baby proved conclusively that he was the father of her child. RESULT: Pled Guilty; 3 years in prison, SES, with 5 years on probation, numerous conditions of probation.
CR501-261F - Dennis K. Ainsworth Perjury
Defendant conspired with Bradley Teichman, a friend, for Teichman to lie at a civil administrative license revocation hearing as to whether Teichman had been the driver on the night of Ainsworth’s DWI. RESULT: Pled guilty to conspiracy to commit perjury; one year in county jail, SES, with probation, fine and 15 days to serve.
CR501-265F - Bradley Teichman Perjury
Defendant lied at a civil administrative license revocation hearing by claiming that he had been the driver of the motor vehicle on the night his friend got a DWI. RESULT: Pled guilty to conspiracy to commit perjury; one year in county jail, SES, with probation, fine and eight days to serve.
CR735-832F
Defendant lied while under oarth druing his guilty plea in a misdemeanor DWI case by swearing falsely under oath that he did not have a criminal history other than a speeding ticket. In truth, he had several criminal convictions, including stealing, possession of marijuana and attempted theft. RESULT: Defendant pled guilty to the felony of perjury and received a sentence of 30 days jail to serve.
